​​Department Terms and Conditions for the use of the Australia Travel Declaration

About these Terms and Conditions

  1. This is an agreement between the user (“you”) of the specific part of the Qantas App referred to as the Australia Travel Declaration (“the ATD”) and the Commonwealth of Australia represented by the Department of Home Affairs (“the Department") governing your use of the ATD.
  2. Please read these Terms and Conditions carefully as you are not required to use the ATD in any way. If you do not submit an ATD, you may be required to submit a paper Incoming Passenger Card on arrival instead.
  3. By choosing to use the ATD, you acknowledge that you agree to be bound by all of the Terms and Conditions. If you do not agree to these Terms and Conditions, you must not use the ATD and you may ask for a paper Incoming Passenger Card.
  4. You acknowledge that these Terms and Conditions may be subject to updates, amendments or additions that the Department will specify on its website, from time to time, and the changes may be incorporated into these Terms and Conditions by reference. If any new changes are incorporated during your use of the ATD and you had relied on the version of the Terms and Conditions prior to the new changes, you may continue to rely on the previous version.
  5. These Terms and Conditions do not affect any agreements you may have in connection with Qantas Airways Limited or the Qantas App.

Your use of the ATD

  1. You agree to use the ATD only for the purposes explained in the ATD.
  2. You agree to not use the ATD for any other purposes, including:
    1. Any commercial purposes;
    2. Any illegal or unauthorised use of the ATD; and
    3. Any unauthorised copying, altering or extracting of information from the ATD in any way.
  3. Your access to the ATD depends on telecommunications infrastructure, internet service providers, the mobile device's technical specifications, the Qantas App, and other external factors unrelated to the Department in any way. While the Department will take reasonable steps to ensure stability of the ATD and the information shown on the ATD accurately reflects what is required by the Department at the time, the Department does not warrant the ATD will be available at all times or the information shown in the ATD is always relevant to the ATD’s purpose.
  4. While the Department will take all reasonable steps to ensure that the information provided by the ATD is correct and current at the time of publication, the Department accepts no responsibility for the completeness or accuracy of any of the information contained in or accessed through the ATD and makes no representations about its suitability for any particular purpose. Users should make their own judgements about those matters.

Intellectual Property

  1. The ATD is protected by copyright. You may only use it for the purpose of preparing and submitting an ATD. You acquire no rights or licences in relation to the ATD.
  2. You will not copy, duplicate, replicate or transform any display or function of the ATD. You must not modify, adapt, reverse engineer, decompile or disassemble the ATD in any way.
  3. Unless stated otherwise, the content of the ATD (including text, graphics, logos, icons, images, video and audio clips and any other form of information or content and design elements) are owned by the Department or Qantas.

General terms

  1. To the maximum extent permitted by law, you agree that:
    1. The Department excludes all liability for loss or damage arising from the use of, or reliance on, the information contained in or accessed through the ATD and related links, whether or not caused by any negligence on the part of the Department or its employees or agents;
    2. The ATD is provided on an 'as is' basis and the Department makes no warranties, express or implied, that the ATD is complete, is error free, or that any defects with the ATD will be rectified; and
    3. The Department, or its agents, will not be held liable for any loss that you might suffer where that loss results from, or is related to, the improper or unauthorised use and/or modification of the ATD by a third party.
  1. The Department accepts no responsibility for the Qantas App, its content, or any form of information provided by Qantas Airways Limited unless it is information for the ATD that has been approved by the Department.
  2. The Department excludes all liability for loss or damage arising from the use of, or reliance on, the information contained in or accessed through the parts of the Qantas App that are outside of the ATD.
  3. These Terms and Conditions constitute your entire agreement with the Department in connection with the ATD. These Terms and Conditions do not affect any agreement you have in connection with the operation of the Apple App Store, Google Play Store and/or Qantas Airways Limited in relation to the Qantas App.
  4. You will be asked to declare and acknowledge various matters before you submit an ATD. These Terms and Conditions do not affect your obligations to provide any information in accordance with the laws of Australia including, but not limited to, the Customs Act 1901 (Cth), the Migration Act 1958 (Cth), Biosecurity Act 2015 (Cth) or any other relevant legislation related to the Incoming Passenger Card. If any part of these Terms and Conditions is illegal or unenforceable under the governing law, the Department may remove it from these Terms and Conditions and the remaining parts will continue to be in force.
  5. These Terms and Conditions are governed by the laws of the Australian Capital Territory, Australia and you agree to submit to the exclusive jurisdiction of the courts in the Australian Capital Territory.

Survivorship

  1. The following items survive termination of these Terms and Conditions:
    1. To the maximum extent permitted by law:
      1. Intellectual Property, clause 10 – 12,
      2. General terms, clause 13- 18, and
      3. Survivorship, clause 19.
    2. Any provision which by implication from its nature is intended to survive termination or expiration, and any rights arising on termination or expiration will survive.
