Collection and use of personal information

We collect, use and disclose personal information contained in the Integration Cargo System (ICS) for the purpose of the reporting and control of the movement of cargo across the Australian border and in administering certain Australian laws including customs, taxation, health, quarantine, criminal, intellectual property and community protection laws, as well as in the reporting and collection of government revenue being customs duty, indirect tax and other charges including quarantine and import processing charges. The information may be used or disclosed to assist the development of relevant Government policies.

If you have engaged a broker, agent or other person to deal with us on your behalf, your personal information may have been collected by that entity.

Disclosure of ICS data

We might disclose your personal information to Australian Government agencies including, tax, finance, statistics, quarantine, law enforcement and infrastructure agencies.

We might also disclose your information to foreign entities including overseas manufacturers, exporters, bodies authorised to issue certificates of origin and foreign government agencies. ACBPS may also disclose your information to foreign entities to give effect to Australia’s international agreements.

In addition to the purposes set out above, we might disclose your information to any of the above entities for an enforcement-related activity or to lessen or prevent a serious threat to life, health or safety.

Basis for collection

In some cases, you are required under the Customs Act 1901 or related legislation to provide your personal information to facilitate the movement of goods. If you do not provide your personal information, we might not be able to facilitate the movement of your goods across the Australian border.
